Privacy Policy

1. This Privacy Policy (hereinafter referred to as the “Privacy Policy”) applies to the use of the software application (hereinafter, the “Application”) available in the Apple Inc. App Store and Google Play of Google Inc., and the “online” platform published at the URL: https://kilimo.com/ (hereinafter, the “Site”), provided by KILIMO, whose main function is to provide a service (hereinafter, the “Service”) for irrigation management in agriculture, improving yields and water use efficiency. If necessary, KILIMO may supplement the Privacy Policy with specific information and/or terms and conditions related to the Service.

Mere access to the Site, as well as the use of the Service, grants the status of User of KILIMO (hereinafter, the “User” or the “Users”) and expresses full and unreserved acceptance of each and every clause of the Privacy Policy in the version published by KILIMO at the very moment the User accesses the Site or uses the Service. Consequently, the Privacy Policy will constitute a valid and binding agreement between the User and KILIMO concerning privacy. Additionally, the use of the Service expresses the full and unreserved acceptance by the User of the Terms and Conditions of Use of the Service (hereinafter, the “Terms and Conditions”) published by KILIMO at www.kilimoagtech.com/terms-and-conditions, which are supplemented by the Privacy Policy.

KILIMO may modify the Privacy Policy at any time. The new versions of the Privacy Policy will be notified by publishing the new version at www.kilimoagtech.com/privacy-policies and notified through the contact means provided by the User.

The User agrees to be deemed notified of any modification to the Privacy Policy once KILIMO has published them at www.kilimoagtech.com/privacy-policies, and that the User’s continuation in the use of the Service once such new version is published will be considered as acceptance of these modifications to the Privacy Policy. Consequently, the User agrees to periodically check www.kilimoagtech.com/privacy-policies.

2. COLLECTION OF USER INFORMATION. PURPOSES.

2.1 The User agrees that KILIMO may collect information about its Users using cookies, tags, and other methods (such as the information provided by Users when making a purchase).

2.2 Additionally, KILIMO may collect and/or store the IP (Internet Protocol) number or address of the Users for the purpose of improving the quality of the Service provided through its website. Storing the IP number of Users’ devices allows KILIMO to identify them when they log into their individual accounts. It also facilitates the diagnosis of potential connection problems that may exist between the KILIMO website and the Users, thereby improving the quality of the Services.

The IP (Internet Protocol) number or address is a numerical identification that distinguishes a computing electronic device (whether it is a computer, a personal phone with network access, a tablet, etc.) that connects to a computer network (e.g., the Internet).

2.3 KILIMO may request and store the User’s personal and billing information: (i) first and last name; (ii) gender; (iii) age; (iv) phone number; (v) address; (vi) postal code; (vii) city; (viii) region; (ix) country of residence; (x) ID number; (xi) email address; (xii) tax ID number (hereinafter, the “Data”). Collecting this information allows KILIMO to offer the User a personalized Service that suits their needs to provide the best possible experience with KILIMO.

KILIMO may store or collect information and data related to Users’ payment methods, such as credit cards, bank accounts, etc. Payment method information may be stored on KILIMO’s servers, and KILIMO may have access to it.

3. USE OF COLLECTED USER INFORMATION

3.1 KILIMO may collect information from Users using cookies and/or tags or any other automated information detection method provided by the tools offered by the Application and/or the Site. The information collected by KILIMO may include browsing behavior, IP addresses, logs, and other types of information. However, KILIMO will not directly collect personally identifiable information from any User using cookies, tags, or any other automated information detection method provided by the tools offered by the Application and/or the Site.

3.2 KILIMO will use the information provided by the User and collected by KILIMO to provide the Service and its improvements to the User, striving to meet their needs.

3.3 KILIMO will use the information provided by the User and collected by KILIMO to analyze it and provide the User with relevant data to offer a better service. For this purpose, KILIMO may send its Users notifications, news, and updates of interest, in addition to notifications of an institutional or legal nature.

3.4 KILIMO will use the information provided by the User and collected by KILIMO to analyze the behaviors and actions of Users on its Site, such as their geographical locations, usage sessions, site visit duration, frequency of use, to improve its Service and provide better solutions to their needs.

3.5 KILIMO may share the information with other service companies or websites to improve the quality of KILIMO’s Service. Generally, these companies or websites have their own data privacy policies for protection purposes. Nonetheless, KILIMO will make its best efforts to ensure that the privacy of the shared information is protected in the best possible manner. Where applicable, KILIMO will attempt to sign explicit agreements on data protection and information privacy. Notwithstanding, KILIMO will not be liable for any damages caused by such companies and/or websites concerning their duty to protect, maintain confidentiality, and ensure the privacy of the data they handle.

3.6 KILIMO will use the information provided by the User and collected by KILIMO if requested by courts or national or international state agencies that require and request it in the appropriate manner.

3.7 KILIMO is not obligated to retain the information for any specific period and will dispose of it when deemed appropriate.

4. THE SITE

4.1 KILIMO will not sell, rent, or trade any Data to any third party for commercial purposes. Anyone who has provided personal contact information through the KILIMO Site may send an email to [email protected] to update, delete, and/or correct their personal contact information. KILIMO will respond to such requests within 30 (thirty) days following receipt of the request via email.

4.2 The KILIMO Site may use cookies to record User patterns. If a User of the Site does not wish to accept these cookies, they can configure their browser to provide the option to accept each cookie and reject those they do not wish to accept. The Site may also use tools to analyze cookies, log files, and tags.

4.3 The KILIMO Site may contain links to other websites that are not owned by KILIMO. Consequently, KILIMO is not responsible for the actions of those websites, to which this Privacy Policy does not apply. We recommend reviewing the privacy policy detailed on those websites to understand their information collection procedures and how they protect your personal data.

4.4 The provisions of the Privacy Policy apply to all KILIMO Users, whether they have entered their Data or not.

5. MINORS

5.1 While the Site and/or the Application and/or the Service are not directed at minors, in the event that a minor accesses them, their use must be supervised by parents, guardians, or legal representatives. The Site and/or the Application and Service are allowed only for those who are of legal contracting age and are not legally inhibited or otherwise prohibited from exercising legal acts, rights, and/or obligations. Given this, minors under 18 years old are not allowed to access the Site and/or the Application and/or the Service, nor are they permitted to provide any Data or any other type of information.

5.2 Furthermore, since minors may not fully understand the Privacy Policy and its implications, nor be able to validly decide on the options available through the Services, KILIMO urges all parents, guardians, or adults under whose supervision minors access the KILIMO Service to actively and carefully participate in the activities the minor engages in on the internet or through the Application, the online Service used by such minors, and the information they access, whether when the minors visit the KILIMO website or any other third-party site. They are encouraged to teach and guide them on how to protect their personal information while browsing the internet.

6. CONFIDENTIALITY AND SECURITY OF INFORMATION

6.1 KILIMO has adopted reasonable security measures to protect User information and prevent unauthorized access to their data or any unauthorized modification, disclosure, or destruction of the same. The information collected by KILIMO will be maintained in strict confidence. Access to personal data is restricted to those employees, contractors, operators, and representatives of KILIMO who need to know such data to perform their functions and develop or improve our Service. KILIMO requires its suppliers to adhere to the same confidentiality standards. KILIMO does not allow third-party access to this information, except for an express request by the User.

6.2 Notwithstanding the above, considering that the internet is an open, public access system, KILIMO cannot guarantee that unauthorized third parties may not eventually overcome security measures and use User information improperly.

7. CHANGES IN CORPORATE STRUCTURE

7.1 KILIMO reserves the right to transfer the collected information in the event of a sale or merger of KILIMO, or an acquisition of KILIMO’s main assets, or any other type of transfer of KILIMO to another entity. In such an event, KILIMO shall take reasonable measures to ensure that such information is used in a manner consistent with the Privacy Policy.

8. USER RIGHTS OVER INFORMATION

8.1 Most browsers are set to accept cookies, but Users can reconfigure their internet browser to reject all cookies or to indicate when a cookie is being sent. However, if cookies are disabled, some features and Services of the website may not function properly.

8.2 KILIMO will strive, by all means at its disposal, to provide Users about whom it has collected or stored personal information with access to their Data (“Right of Access”), as well as the rectification, modification, or update of such data (“Right of Rectification”), or even the cancellation of such personal data (“Right of Removal”), unless KILIMO can deny such requests (hereinafter, the “Requests”) if it is obliged or entitled to retain such Data in accordance with applicable law.

  1. To Exercise These Rights The User must send their Request by emailing with the subject “Access to Personal Data” to [email protected]. KILIMO may require the User to identify themselves, which KILIMO may verify, and to specify the Data they wish to access, rectify, or remove.
  2. KILIMO may reject Requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of other Users, are deemed impractical, or for which access to the Data is not necessary.
  3. The service of accessing, rectifying, and removing Data will be provided by KILIMO free of charge, except in cases where it requires a disproportionate or unreasonable effort, in which case an administrative fee may be charged.

The holder of personal data has the right to exercise the right to access them free of charge at intervals of no less than six months, unless a legitimate interest is demonstrated in accordance with Article 14, Paragraph 3 of Law No. 25.326 of the Argentine Republic. The enforcement authority (in Argentina, the National Directorate for Personal Data Protection, the supervisory body of Law No. 25.326), has the authority to address complaints and claims related to the violation of personal data protection regulations.

9. EXCEPTIONS

9.1 Notwithstanding any other provision to the contrary in the Privacy Policy, KILIMO may disclose certain personal information of Users when it believes in good faith that such disclosure is reasonably necessary to:

  1. Avoid legal liability;
  2. Comply with a legal requirement, such as a search warrant, subpoena, or court order;
  3. Fulfill a request from a governmental or regulatory authority; and/or
  4. Protect the rights, property, or safety of KILIMO, the Users, or a third party.

10. THIRD-PARTY SERVICES

10.1 KILIMO may use third-party services, for which it is not responsible for the information they collect or the way they protect your personal information. Each of these third-party services has its own privacy policies and, where available, provides a method for Users to opt-out.

11. CHANGES TO THE PRIVACY POLICY

11.1 KILIMO may modify this Privacy Policy if it deems it appropriate. If the changes are substantial regarding the treatment of Data collected through the use of the Services, such changes will be notified by publishing a prominent notice on the Site and by sending an email to the address provided by the User.
